We are a law office specializing in chapter 7 bankruptcy cases. The new bankruptcy laws went into effect October 17, 2005, and relief is still available under chapter 7 and chapter 13 bankruptcy laws.
The new law requires all individual debtors who file bankruptcy after October 17, 2005, to complete a consumer credit counseling course before the bankruptcy petition is filed and to complete a financial management instructional course after the petition is filed. The process is easy, it only takes about 30 minutes and can be completed online through approved agencies.
To determine if you qualify to file chapter 7 or chapter 13 a simple and easy means test is applied to analyze total income and expenses. The means test also includes a state median income that the courts will look at to see if your income is below the state median income level. This is important because we will need the past 6 months past pay stubs to make this determination.
